1. Introduction

These Terms of Service (“Terms”) govern your access to and use of:

The Services are provided by Smart Software Services B.V. (“BlockSight”, “we”, “our” or “us”).

By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree, you must not use the Services.

2. Eligibility

You must:

  • be at least 18 years old;
  • have legal capacity to enter into contracts;
  • if acting on behalf of an organisation, have authority to bind that organisation;
  • comply with all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

3. Description of the Services

BlockSight provides blockchain intelligence software designed to assist users in understanding blockchain activity and associated risks.

Services may include:

  • wallet analysis;
  • transaction analysis;
  • entity identification;
  • behavioural profiling;
  • sanctions screening;
  • fraud detection;
  • risk scoring;
  • predictive analytics;
  • machine learning models;
  • reporting;
  • APIs;
  • investigative tooling.

The Services may evolve over time. We may introduce, modify or remove features at any time.

4. Nature of BlockSight’s outputs

The Services generate analytical outputs designed to assist human decision-making.

These outputs may include:

  • statistical analyses;
  • behavioural assessments;
  • predictive models;
  • heuristic classifications;
  • confidence scores;
  • entity attributions;
  • risk indicators.

Unless expressly stated otherwise, these outputs represent probabilistic analytical opinions rather than verified facts.

Risk scores represent an estimate of the likelihood of certain characteristics or behaviours based on available information and model outputs.

No output should be interpreted as conclusive evidence that a wallet, transaction or entity:

  • is fraudulent;
  • has engaged in criminal conduct;
  • is controlled by a particular individual or organisation;
  • violates sanctions;
  • presents no risk.

5. Sources of information

Our analyses may incorporate information from multiple sources, including:

  • public blockchain networks;
  • open-source intelligence;
  • publicly available records;
  • commercial data providers;
  • customer-provided information;
  • internally generated datasets;
  • machine learning models developed by BlockSight.

We perform quality assurance and continuously improve our data pipelines.

However, neither blockchain data nor third-party information is guaranteed to be complete, accurate or current.

New information may materially change previous analyses.

6. Continuous model evolution

Blockchain intelligence is inherently dynamic.

Our models, heuristics and datasets evolve continuously as:

  • new blockchain activity occurs;
  • additional intelligence becomes available;
  • attribution improves;
  • false positives are corrected;
  • false negatives are discovered;
  • machine learning models are retrained;
  • behavioural models are refined.

Accordingly:

  • historical reports may differ from current reports;
  • risk scores may increase or decrease;
  • classifications may change;
  • confidence levels may change.

Such changes do not necessarily indicate that earlier analyses were incorrect.

7. Customer responsibilities

You remain solely responsible for:

  • evaluating information produced by the Services;
  • verifying conclusions before taking action;
  • complying with applicable laws;
  • exercising appropriate professional judgement.

You should not rely solely upon BlockSight outputs when making legal, financial, investment, regulatory or enforcement decisions.

8. No professional advice

The Services do not constitute:

  • legal advice;
  • financial advice;
  • investment advice;
  • accounting advice;
  • tax advice;
  • regulatory advice;
  • compliance advice.

Nothing within the Services creates a solicitor-client, fiduciary or professional advisory relationship.

Independent professional advice should be obtained where appropriate.

9. Regulatory responsibility

BlockSight is an analytical platform.

Customers remain solely responsible for satisfying their own legal and regulatory obligations, including, where applicable:

  • Anti-Money Laundering (AML);
  • Counter-Terrorist Financing (CTF);
  • Know Your Customer (KYC);
  • sanctions compliance;
  • suspicious activity reporting;
  • financial crime investigations.

Use of the Services does not itself satisfy any statutory or regulatory requirement.

10. No warranty of accuracy

To the maximum extent permitted by law, BlockSight does not warrant that:

  • any score is accurate;
  • any entity attribution is correct;
  • any prediction will prove correct;
  • all malicious behaviour will be detected;
  • all legitimate behaviour will be recognised;
  • any blockchain address belongs to a particular person;
  • all information is complete.

The absence of a risk indicator does not imply safety.

The presence of a risk indicator does not establish wrongdoing.

11. Investigation and enforcement

BlockSight is an intelligence and analytical platform intended to support investigations and risk assessment.

The Services are designed to assist users in identifying potential areas of concern, prioritising investigative effort and informing professional judgement. They are not intended to replace appropriate human review, due diligence or independent verification.

Before taking material action based on BlockSight outputs, including but not limited to:

  • freezing or restricting assets;
  • blocking or terminating customer accounts;
  • filing Suspicious Activity Reports (SARs) or equivalent regulatory reports;
  • reporting individuals or organisations to law enforcement or regulators;
  • initiating legal proceedings;
  • declining or terminating commercial relationships;

you are responsible for conducting your own investigation and corroborating relevant findings using appropriate evidence and procedures.

BlockSight does not determine whether any person or entity has engaged in unlawful conduct, nor does it make regulatory or enforcement decisions on behalf of its users.

You remain solely responsible for all decisions, actions and omissions arising from your use of the Services.

12. Fairness and intended use

BlockSight analyses blockchain activity.

Our models are not designed to infer, predict or classify protected personal characteristics such as race, religion, ethnicity, political opinion, sexual orientation or other protected attributes.

Users must not use the Services in ways that violate applicable anti-discrimination or human rights laws.

13. Acceptable use

You agree not to:

  • misuse the Services;
  • interfere with platform security;
  • attempt to reverse engineer proprietary models;
  • circumvent rate limits;
  • scrape data except through authorised interfaces;
  • upload malicious software;
  • interfere with other users;
  • use the Services for unlawful purposes;
  • impersonate another person;
  • misrepresent BlockSight outputs.

14. Intellectual property

All intellectual property rights in the Services remain the property of Smart Software Services B.V. or its licensors.

This includes:

  • software;
  • APIs;
  • databases;
  • machine learning models;
  • behavioural models;
  • documentation;
  • reports;
  • trademarks;
  • visualisations.

Except as permitted by law, you may not:

  • redistribute proprietary datasets;
  • resell BlockSight outputs without permission;
  • copy substantial portions of the Services;
  • create competing products using proprietary outputs.

15. APIs and platform changes

We reserve the right to:

  • modify APIs;
  • update scoring methodologies;
  • retrain models;
  • introduce new features;
  • retire existing functionality.

Unless expressly agreed otherwise in writing, we do not guarantee backward compatibility between model versions, APIs or scoring methodologies.

16. Beta and experimental features

Certain features may be designated as:

  • Beta;
  • Preview;
  • Experimental;
  • Early Access.

These features:

  • may change without notice;
  • may produce inaccurate or incomplete results;
  • may be withdrawn at any time;
  • are provided without additional warranties.

17. Feedback

You may voluntarily provide suggestions, bug reports or feedback.

Unless otherwise agreed, you grant BlockSight a perpetual, worldwide, royalty-free licence to use such feedback to improve the Services.

This does not transfer ownership of your underlying data.

18. Third-party services

The Services rely upon third-party providers, including infrastructure, authentication and communications providers.

We are not responsible for interruptions or failures caused by third-party services.

19. Availability

We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.

Maintenance, upgrades, security incidents or third-party outages may temporarily affect availability.

20. Data ownership

You retain ownership of data that you submit to the Services.

Subject to our Privacy Policy, you grant BlockSight a licence to process that data as necessary to operate, secure and improve the Services.

Generated scores, models, derived analytics and platform outputs remain the intellectual property of BlockSight unless otherwise agreed.

21. Export controls and sanctions

You may not use the Services:

  • in violation of applicable export control laws;
  • in violation of sanctions laws;
  • for the benefit of sanctioned persons where prohibited by law;
  • in support of unlawful activities.

You are responsible for ensuring your own compliance with applicable laws.

22. Suspension and termination

We may suspend or terminate access where:

  • these Terms are breached;
  • unlawful activity is suspected;
  • platform security is threatened;
  • continued access would expose us or other users to material risk.

You may stop using the Services at any time.

23. Privacy

Use of the Services is also governed by our Privacy Policy.

24. Disclaimer of warranties

Except where prohibited by law, the Services are provided “as is” and “as available.”

We disclaim all warranties, express or implied, including warranties of:

  • merchantability;
  • fitness for a particular purpose;
  • non-infringement;
  • uninterrupted availability.

25. Limitation of liability

To the maximum extent permitted by law:

  • BlockSight shall not be liable for indirect, incidental, consequential, special or punitive damages;
  • BlockSight shall not be liable for lost profits, business interruption, loss of opportunity or reputational harm;
  • our total aggregate liability arising from the Services shall not exceed the fees paid by you during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.

26. Indemnity

You agree to indemnify and hold harmless Smart Software Services B.V., its directors, employees and affiliates from claims, liabilities, losses and expenses arising from:

  • your misuse of the Services;
  • your breach of these Terms;
  • your violation of applicable law;
  • your infringement of third-party rights.

27. Changes to these Terms

We may update these Terms from time to time.

Material changes will be notified through the Services where appropriate.

Continued use of the Services following the effective date of revised Terms constitutes acceptance of those Terms.

28. Governing law

These Terms are governed by the laws of the Netherlands.

Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.
